FahrenFlight Terms of Use

These terms govern the use of the FahrenFlight app ("the app" or "the service"), offered by Catalin Florin Coada, Via Rodolfo Morandi 18, 20068 Peschiera Borromeo (MI), Italy ("we"). By using the app you accept them. If you do not accept them, do not use the app.

How we process your data is explained in the Privacy Policy (fahrenflight.app/en/privacy).

1. Who can use the app

To create an account you must be at least 14 years old, or the higher age set in your country; below that age a parent's consent is required. You are responsible for what happens with your account: keep your password safe and tell us if you think someone else is using it.

2. The service

FahrenFlight lets you keep a diary of your travels on a globe, collect miles, FahrenPoints and badges, play the Gate, take part in the Sky League, create reels and postcards, and meet and challenge other travellers ("Flighters").

The service changes over time: we may add, change or remove features. Some features are in preview and may not always work. We do our best to keep the app available, but we cannot guarantee that it will be without interruptions or errors.

3. Travel information

The app's descriptions, tips, curiosities, prices, opening hours and warnings are there to inspire and guide you. They may be incomplete or out of date, and they do not replace official sources. Before you leave, check documents, entry requirements, opening hours and prices with official sources, and your government's travel safety advice. The app's warnings about war zones or dangerous areas are not an opinion on the safety of a trip.

4. Your content

The content you create is yours: trips, photos, texts, nickname, bio, messages, postcards. It stays yours. For the content you choose to show to others — your public profile, challenges, Gold Postcards shared with a link — you give us a free permission, limited to running the service, to store it and show it to the people it is meant for, for the time stated in the Privacy Policy.

You confirm that you have the right to publish what you share, and that the people recognisable in your photos agree to it.

5. Rules of conduct

We do not tolerate objectionable content or abusive behaviour. You may not use the app to:

• publish illegal, violent, pornographic or sexually explicit content, or any content that sexualises minors;
• harass, threaten, insult or discriminate against anyone, including on the grounds of origin, religion, gender, sexual orientation or disability;
• impersonate another person, or use a nickname that is misleading or offensive;
• publish other people's personal data or photos without their consent;
• send spam, advertising or scams;
• get around the limits of the service, attack it, copy its content in bulk or use it with automated tools.

You can report content or a user and block a user from the app. We review reports within 24 hours and, if they break these rules, we remove the content and may suspend or close the account of whoever broke them.

6. Business Class

Business Class is an auto-renewing subscription that unlocks the features shown in the app at the time of purchase (for example unlimited trips and photos, reels and 12 Gold Postcards included every 12 months).

• Price and duration are shown before purchase. Payment is charged to your App Store or Google Play account when you confirm.
• The subscription renews automatically at the same price unless it is cancelled at least 24 hours before the end of the current period; the renewal is charged within the 24 hours before it ends.
• You can manage or cancel it at any time in your App Store or Google Play account settings. Once cancelled, it stays active until the end of the period already paid for.
• Refunds are handled by Apple or Google under their own rules.
• If we change the price, Apple or Google will tell you before the renewal, as their rules require.

7. FahrenCoins

FahrenCoins are a virtual currency of the app: they are used for hints in the Gate and for sending a Gold Postcard. You receive some as a gift at the start or buy them in packs from the App Store or Google Play; the price in euros is always shown.

• FahrenCoins have no monetary value, cannot be converted into money and cannot be transferred to other accounts.
• They are credited immediately after purchase. By asking for immediate delivery of digital content, you accept that the 14-day right of withdrawal no longer applies once delivery has taken place (Art. 59(1)(o) of the Italian Consumer Code). The refunds provided by Apple, Google and the law remain.
• With an account, your balance is saved there; without an account it stays on the phone. If you delete your account, or the app without an account, any unspent FahrenCoins are lost.

8. What is ours

The app, its name and logo, the texts, illustrations, maps, the Gate and its questions belong to us or to those who licensed them to us. You may use them only within the app, for personal use. Some data comes from third parties under their own licences, shown in the app (for example country borders from GeoNames, CC BY 4.0).

9. Suspension and deletion

You can stop using the app and delete your account whenever you want, from the app. We may suspend or close an account that breaks these terms or the law, after telling you when possible. Closing it does not take away the rights the law gives you as a consumer.

10. Liability

The app is offered as it is. To the extent permitted by law, we are not liable for indirect damage, for decisions you take based on the app's travel information (section 3), or for what other users publish. Nothing in these terms limits our liability for wilful misconduct or gross negligence, or the rights the law gives you as a consumer.

11. App downloaded from the App Store

If you downloaded the app from Apple's App Store:

• these terms are between you and us, not between you and Apple. Apple is not responsible for the app or its content;
• you may use the app on Apple devices that you own or control, within the limits of the App Store's usage rules;
• Apple has no obligation to provide maintenance or support for the app: for support, write to us;
• if the app fails to conform to an applicable warranty, you may notify Apple, which will refund any price paid for the app; otherwise, to the extent permitted by law, Apple has no other warranty obligation;
• claims relating to the app (for example on product liability, legal compliance or consumer protection) must be addressed to us, not to Apple;
• if anyone claims that the app infringes their intellectual property rights, we deal with it, not Apple;
• you confirm that you are not located in a country subject to a United States embargo and that you are not on any list of parties with whom trade is prohibited;
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

12. Changes to the terms

We may update these terms, for example when the service or the law changes. If the changes are significant, we tell you in the app before they apply. If you keep using the app afterwards, you accept them; otherwise you can delete your account.

13. Law and jurisdiction

These terms are governed by Italian law. If you are a consumer, the more favourable rules of the country where you live still apply, and disputes are heard by the court of the place where you reside.
